A wrongful death action is a right to sue given to the surviving family members of a deceased family member. In order to bring a wrongful death action, a death must have been caused by the wrongful, negligent, careless, or reckless act of a person, company or municipality. The Wrongful Death Statute was adopted so that the family members of a deceased can bring the legal action that the deceased would have brought, had death not ensued.
In other words, if the injured party is alive, then a wrongful action does not exist and only the injured party may sue.
Wrongful Death Lawsuit Eligibility
  • Immediate family members - including parents, spouses, and children, are almost always eligible to file a claim, although minors may need an adult guardian to take a Wrongful Death lawsuit to court.
  • Additionally, other family members - such as stepparents, grandparents, and dependents, may also be permitted to file suit in some states.
  • Although laws vary from state to state, immediate family members - including parents, spouses, and children - are permitted to file Wrongful Death claims. Minors, however, may need an adult guardian to bring a lawsuit to court.
